When selling land for development, key legal aspects include ensuring a clear title, understanding zoning regulations, and considering any environmental restrictions. WHAT IS AN OPTION AGREEMENT?

An Option Agreement is a legally binding contract that gives us the right to purchase your land within a specified timeframe, subject to securing planning permission.

WHAT WILL YOU BE ABLE TO OFFER ME?

Following a site visit, our expert planners and architects will assess the potential and draft a proposed scheme. We will then present you with an offer within 4 to 6 weeks.

WILL THE OFFER PRICE BE AGREED BEFORE THE OPTION AGREEMENT IS SIGNED?

Yes, the price will be agreed upon before signing and confirmed in the contract.

WILL THE INITIAL OFFER PRICE CHANGE?

No, the agreed price will be stated in the Option Agreement and remains fixed through to the final sale.

CAN YOU OFFER A CASH/OUTRIGHT PURCHASE?

We typically do not offer outright cash purchases, as securing planning permission is a key part of our process. The Option Agreement ensures a structured approach to maximising land value.

HOW LONG WILL THE OPTION AGREEMENT LAST?

Usually, our Option Agreements last for 12 months, with a possible 6-month extension if additional planning work is required.

COULD THE DEAL BE COMPLETED IN LESS THAN 12 MONTHS?

Yes. While we allow up to 12 months, we aim to secure planning and progress as quickly as possible.

DO I NEED A SOLICITOR?

Yes, we recommend working with a solicitor experienced in Option Agreements. We can suggest trusted professionals if needed.

CAN I STIPULATE MY CONDITIONS BEFORE SIGNING THE OPTION AGREEMENT?

Yes, you can specify any conditions, and they will be reviewed before finalising the agreement.

CAN I REVIEW THE FINAL DRAFT OF THE OPTION AGREEMENT BEFORE SIGNING?

Yes, you can review the agreement as many times as necessary before signing.

HOW LONG DOES IT TAKE TO FINALISE AN OPTION AGREEMENT?

This depends on the complexity of the site and planning process. It can take as little as 4 months or up to 12 months or more.

WILL I HAVE TO PAY ANYTHING?

No, we cover all legal costs up to £2,500 (plus VAT) and all planning expenses.

WILL THERE BE A LOT OF PAPERWORK?

You will need to review and sign the Option Agreement and Transfer Deed. Your solicitor will assist with this. Additionally, you may need to complete a TA6 Property Information Form and an Additional Development Enquiries form.

WILL YOU NEED ACCESS TO MY PROPERTY AFTER SIGNING THE OPTION AGREEMENT?

Yes, we will require access for necessary surveys and investigations, such as Topographical Surveys, Ecology Reports, and Site Investigations. We will always provide at least 48 hours’ notice before any site visit.

DO I NEED PERMISSION FROM MY MORTGAGE LENDER?

Yes, if you have a mortgage on the property, you will need to obtain consent from your lender before proceeding.
